Botha sentenced to life in prison for choking and raping his 78-year-old aunt

The Itsoseng Regional Court sentenced Nkagisang Botha(32) to life imprisonment for raping his 78-year-old aunt yesterday.

 

Police report reveals that in the early hours of 23 October 2017 at Mooinoi, the victim was woken up by a noise to which she went to investigate.

 

She was then confronted by BBotha, whostrangled and subsequently raped her on the floor. He, later on, dragged her to the bedroom and raped her again.

At the time of the incident, the victim could not see who the perpetrator was, as it was dark.

 

The victim reported the matter to the neighbors, who subsequently called her late son who was a police captain at the time.

Regional NPA Spokesperson, all the exhibits were collected at the scene for forensic analysis.

 

“Among them was a sheet that was on top of the bed where the second rape occurred. In February 2018, the DNA results came back positive, linking Botha to the commissioning of the offence and he was later arrested and charged with rape,” said Mamothame.

In aggravation of the sentence, Adv Isaac Boikanyo argued that the accused was remorseless and he offended an elderly woman that he was expected to respect and protect.

 

In sentencing Botha, Magistrate Boitumelo Chulu shared the sentiments with the state. He alluded to the responsibility bestowed on the criminal justice system to protect the most vulnerable members of society.

The Acting Director of Public Prosecutions in the North West, Dr Rachel Makhari-Sekhaolelo lauded the SAPS and the state prosecutor on a successful conviction.
